1. Operator and scope of these terms

BanCaller is provided and licensed by WISE Group Sp. z o.o., ul. Poznańska 64, 05-850 Jawczyce, Poland, KRS 0000957362, NIP 1182237693. Full details, including the registration court and share capital, are available in the Legal notice.

These terms apply to the bancaller.com website and the BanCaller apps for iOS and Android. BanCaller helps identify unwanted calls using a shared number database, user reports and operator moderation.

2. Conditions of use

BanCaller is free of charge, with no advertising, subscriptions or in-app purchases. You remain responsible for any internet and call charges under your agreement with your telecommunications provider.

The website requires a current browser, while the app requires a compatible iOS or Android device. The store listing for a specific release states its requirements. Device verification, database downloads, account operation and report submission require internet access. Identification requires the relevant system features and permissions to be enabled.

The service is intended for international use, subject to local law, store availability and technical restrictions. We do not set one universal minimum age. A minor must use the service with the consent or involvement of a legal representative whenever applicable law requires it. The absence of our own age threshold does not waive those requirements.

You may read, save or print these terms from your browser free of charge. Information about data is available in the Privacy Policy. Making that policy available does not replace consent where consent is required for a particular operation.

3. Accounts and devices

Basic protection does not require an account. However, app access to protected server features requires device registration and approval. BanCaller uses authenticity verification and anti-abuse controls.

When registering an account, you provide a nickname and your own email address. You activate the account by email and set a password during confirmation. The account agreement is concluded after registration and activation are successfully completed. Keep your password secure and do not give others access to your account.

Assigning a device links it to the first account owner and that assignment cannot be transferred to another account. Earlier reports made without an account do not retroactively become reports by the signed-in user and do not award points to that user.

An account lets you review assigned devices, report and point history, and use available spam-label reset features. Operations depend on account and device state and on anti-abuse rules.

4. How protection works and its limitations

Identification uses a local copy of the database. An update has to be downloaded and applied; a PUSH notification does not guarantee an immediate update. Background operation, the range of supported calls and warning presentation also depend on the operating system and phone settings.

Labels are supporting information, not a guarantee. An unknown number, a number without a warning or a verified number may still be unsafe. A number can be spoofed, reassigned or incorrectly reported. A category label does not determine the caller’s identity or establish that a crime has been committed.

A spam label does not itself mean automatic blocking. Rejecting or silencing numbers selected for blocking depends on platform capabilities and the user’s choice. An incorrect label may make an important call harder to receive; users can change their settings or disable protection.

BanCaller is not a substitute for caution, contacting your bank or public authorities, or independently verifying a caller’s identity. Do not provide codes, passwords or money solely because of a label shown in the app.

5. Reports, moderation and points

Report numbers according to your genuine experience and choose the matching category. Knowingly submitting false reports, manipulating number reputation, bypassing limits or blocks and automating abuse are prohibited.

On iOS, new reports are initiated for a call or message selected through the system feature. On Android, they originate from the call card made available by the app. A call, a number search or rejecting a call does not by itself consent to sending a report.

Submitted information is used to build and update the shared database. Categories and statuses may be calculated automatically and changed by authorised people. WISE Group may also add numbers and labels manually. An incorrect entry can be reported to the operator without creating an account.

Points reflect account activity under the app’s rules. They are not money, a means of payment or an obligation to pay compensation. A report does not guarantee a change in number status or the award of a bonus.

6. End-user licence

WISE Group grants you a non-exclusive, royalty-free and non-transferable licence to install and use the BanCaller app on devices that you own or are authorised to use, solely to access the service features. The licence does not transfer ownership of the code, marks or database.

Unless separately authorised, you may not sell, sublicense or distribute modified copies of the app, remove legal notices or circumvent safeguards. These restrictions do not exclude acts permitted by mandatory law, including statutory interoperability rights.

Third-party components and open-source software are subject to their applicable licences. These terms do not restrict rights granted by those licences. When using the app, you must also comply with applicable operating system, store and telecommunications service terms.

7. Additional terms for iOS

The licence agreement is between you and WISE Group, not Apple. WISE is responsible for the app, its content, maintenance and support, and for claims relating to the product, legal compliance, privacy and infringement of third-party intellectual property rights. Apple has no obligation to provide maintenance or support.

The licence covers Apple-branded devices that you own or control, as permitted by the Apple Media Services Usage Rules, including Family Sharing and volume purchasing to the extent Apple permits them.

If the app fails to conform to an applicable warranty, you may notify Apple, which will refund any purchase price. To the maximum extent permitted by law, Apple has no other warranty obligations; the remaining obligations relating to the app rest with WISE. BanCaller is currently free of charge.

Use must comply with applicable US sanctions and export laws: you may not be located in a country subject to a relevant embargo or designated as supporting terrorism, or appear on a relevant prohibited-party list. Apple and its subsidiaries are third-party beneficiaries of the EULA and may enforce it. Nothing in these terms restricts consumer rights beyond what the law permits.

8. Access restrictions and ending use

You may stop using the app, disable its permissions or uninstall it. To end use of your account, use the account deletion feature in the app or the web account panel. Uninstalling the app does not delete the server account.

The operator may restrict access because of abuse, a breach of these terms, security concerns or missing required device verification. A restriction should correspond to its cause; you may ask the operator for an explanation and another review. This does not grant the operator a right to disregard statutory obligations.

Account deletion is permanent and ends access for assigned devices. It does not delete the entire shared database or every historical record. The rules for pseudonymisation and backup retention are described in the Privacy Policy.

9. Contact and complaints

Send complaints about BanCaller operation to support@bancaller.com or by post to the operator’s address. Describe the issue, when it occurred, the platform and app version if known, and how you would like to receive a response. Do not send your password or full access credentials.

A report may also concern an incorrect number label, an access block or an infringement of rights. For personal data matters, contact odo@wise.pl. If additional information is needed to investigate, the operator may request it to the extent necessary.

We handle complaints without undue delay and within legally required periods. For consumer complaints, a response will generally be provided within 14 days unless an applicable rule states otherwise. Making a complaint does not remove your right to contact a competent authority or court or to use an available out-of-court procedure.

10. Liability and user rights

The operator is liable under applicable law. Information about technical limitations is not a complete exclusion of liability. These terms do not exclude consumer rights concerning conformity of digital services or content, updates, remedies or withdrawal where those rights apply.

We do not guarantee detection of every unwanted call, the correctness of every report or uninterrupted availability of all features. Maintenance, an app or database update, or re-enabling system features may be required.

11. Governing law and changes

These terms are governed by Polish law, without depriving a consumer of protection under mandatory rules applicable at their habitual place of residence. We do not establish exclusive court jurisdiction that would restrict a user’s statutory rights.

Changes may result from changes to service features, legal requirements or security. A new version should state its effective date. Changes affecting an ongoing agreement require the user to be informed and their rights to be respected and, where required, their acceptance to be obtained. Merely replacing text on the website does not replace those steps.
